Acceptance of terms

These Terms & Conditions ("Terms") govern your access to and use of the Ascend platform (the "Service"), provided by Tariah Artificial Intelligence ("we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

Description of service

Ascend is an AI-powered readiness assessment platform that evaluates individuals, founders, teams, and organisations across seven strategic dimensions of AI adoption. The Service generates maturity scores, intelligence reports, strategic roadmaps, and AI tool recommendations based on your responses.

Acceptable use

You agree not to misuse the Service. Specifically, you must not:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Engage in fraud, spam, or deceptive practices.
• Infringe intellectual property rights or distribute content you do not have rights to.
• Interfere with or disrupt the security, integrity, or performance of the Service, including through malware, probing, scraping, or unauthorised access attempts.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Resell, redistribute, or circumvent technical limits of the Service.

Accounts and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it updated. You must notify us immediately of any unauthorised use of your account.

Intellectual property

Tariah Artificial Intelligence retains all rights, title, and interest in and to the Service, including all software, documentation, branding, and underlying intellectual property. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms and your selected plan.

Payment terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

AI-generated content

The Service uses artificial intelligence to generate assessments, reports, and recommendations. You are responsible for your prompts, inputs, and how you use the outputs. AI-generated outputs may be inaccurate or incomplete and should not be relied upon as professional advice in regulated fields (such as legal, medical, or financial advice) without independent verification. We reserve the right to moderate content, refuse or filter outputs, and suspend accounts for prohibited use.

Prohibited uses of AI-generated content include:

• Creating illegal content, deepfakes, hate speech, malware, or attempting to jailbreak the system.
• Using outputs for purposes that infringe third-party rights.
• Distributing AI-generated content as factual without verification where accuracy is critical.

Service level

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service immediately ceases. You may request export of your data within a reasonable window before deletion.

Limitation of liability

To the fullest extent permitted by law, Tariah Artificial Intelligence's aggregate liability shall be limited to the fees you paid to us in the six months preceding the claim. We shall not be liable for any indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill, except where liability cannot be excluded by law (such as for fraud, death, or personal injury).

Indemnity

You agree to indemnify and hold harmless Tariah Artificial Intelligence and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tariah Artificial Intelligence operates, without regard to conflict of law principles.

Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a revised date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
